PAN – Ocean Experiences Last updated: July 2026

1. General

These Terms & Conditions apply to all bookings made with PAN – Ocean Experiences for fishing charters, coastal excursions, and private boat hire in Malindi, Kenya.

By confirming a booking, you agree to these terms.

2. Booking & Payment

A 50% deposit is required to confirm your booking.
The remaining balance must be paid in full before departure.
Bookings are confirmed only upon receipt of the deposit.
Accepted payment methods will be communicated at time of booking.

3. Cancellation Policy

Cancellation by the client:

More than 4 days before departure: deposit refunded in full.
Less than 4 days before departure: deposit is non-refundable.
No-show on the day: no refund.

Cancellation by PAN – Ocean Experiences:

If we cancel due to weather or sea conditions, you will get the option to reschedule at no extra cost.

4. Weather & Sea Conditions

The safety of our guests and crew is our priority. PAN – Ocean Experiences reserves the right to cancel or modify any trip due to adverse weather conditions, rough seas, or other safety concerns.

In the event of cancellation due to weather:

You will be offered a full refund or an alternative date.
No compensation will be offered for travel or accommodation costs incurred.

5. Liability

PAN – Ocean Experiences carries appropriate safety equipment on board all trips.
Guests participate in all activities at their own risk.
PAN – Ocean Experiences is not liable for personal injury, loss of personal belongings, or any damages arising from participation in our excursions.
Guests are responsible for their own travel insurance.

6. Guest Conduct

Guests must follow all safety instructions given by the captain and crew.
PAN – Ocean Experiences reserves the right to refuse service or end a trip early if a guest’s behaviour endangers the safety or enjoyment of others.
Alcohol consumption is permitted in moderation; guests who are visibly intoxicated may be refused boarding.

7. Catch & Release

PAN – Ocean Experiences encourages responsible fishing. Catch-and-release practices are respected whenever possible, particularly for billfish species (marlin, sailfish).

8. Children

Children are welcome on board. Parents or guardians are responsible for the safety and supervision of minors at all times.

9. Changes to These Terms

PAN – Ocean Experiences reserves the right to update these Terms & Conditions at any time. The most recent version will always be available on this page.
